1. Introduction

The Ministry of Transport of the Republic of Angola is committed to ensuring the protection, confidentiality, and integrity of personal data processed within the MintransTenders.ao platform, in the context of the concession process for the Caio Deep Water Terminal.

The processing of personal data is carried out in accordance with the Angolan Personal Data Protection Law and, where applicable, aligned with international best practices, including the General Data Protection Regulation (GDPR).

This Policy sets out the terms under which personal data is collected, used, stored, protected, and shared.

In the context of the use of the platform and institutional communication and lead generation campaigns, the following personal data may be processed:

Personal data is processed exclusively for the following purposes:

  • Providing information about the Caio Terminal tender

Note: Personal data will not be used for independent commercial, promotional, or marketing purposes.

5. Legal Basis for Processing

The processing of personal data is based on the following legal grounds:

  • Performance of pre-contractual steps at the request of the data subject, within the framework of expressing interest in the concession process
  • Pursuit of public interest related to the conduct of a public concession procedure for strategic infrastructure
  • Consent of the data subject, where applicable, particularly in the context of digital forms and lead generation campaigns

The Ministry ensures that personal data is processed in accordance with the following principles:

  • Lawfulness, fairness, and transparency
  • Purpose limitation
  • Data minimisation
  • Accuracy
  • Storage limitation
  • Integrity and confidentiality

7. Data Sharing

Personal data may only be shared in the following situations:

  • With public or regulatory authorities, where required by law
  • With technology service providers acting under the Ministry’s instructions

  • The use of data for their own purposes is strictly prohibited

8. International Data Transfers

Given the international nature of the tender and the use of global digital platforms (including communication and lead generation tools), personal data may be transferred outside the Republic of Angola.

In such cases, the Ministry ensures that:

  • Transfers are carried out based on appropriate safeguards
  • Contractual and organisational measures are implemented to protect the data
  • An equivalent level of protection to that provided under Angolan data protection law is ensured

9. Data Security

The Ministry implements appropriate technical and organisational measures to protect personal data against:

  • Loss, destruction, or accidental damage
  • Alteration, disclosure, or misuse

Such measures include, in particular:

  • Access control mechanisms
  • IT systems protection
  • Confidentiality protocols
  • Monitoring of access and operations

10. Data Retention

Personal data will be retained:

  • For the period necessary to manage the concession process
  • Until the completion of the tender and its award
  • For an additional period required to comply with legal obligations or audits

After this period, the data will be securely deleted or anonymised.

Under applicable law, data subjects have the right to:

  • Request rectification of inaccurate or incomplete data
  • Request erasure of data, where legally permissible

12. Data Protection Officer (DPO)

The Ministry reserves the right to update this Privacy Policy whenever necessary. Any changes will be duly published on the platform.
